the development process which will be smoothed by identifying
and confronting at an early stage the key issues highlighted

Rights of Light
Recent case law appears to have enhanced the rights of those
whose light is infringed by redevelopments. With decisions
affirming that an injunction is the primary remedy for an
interference with property rights and indications that the
level of damages for infringements may be increasing, developers
need to be more aware than ever of how rights of light operate,
and how they can be prevented from hindering a redevelopment.

Planning the New Landscape
A reflection upon a period of major reform in the planning
system which has created a radically different planning landscape
with the introduction of local development frameworks. This
draws upon recent experiences, and highlights practical ways
in which Developers can embrace the new system effectively
and profitably. It also considers proposals for further reform
under the Planning Bill, including the Government's plans
for a new financial tariff called the "community infrastructure
levy".

Developments in Construction standard forms and dispute
resolution
There has been a plethora of new construction "standard
form" contracts published over recent years, relating
to both building contracts and professional appointments.
The Government seems to be backing NEC3 for major public procurement.
What are the real differences between these forms, and do
they matter much? Do so called "patterning" forms
really result in fewer disputes? What dispute resolution options
seem to work best for the parties to construction contracts?

in relation to design liability.

Tax Breaks for Development Expenditure
Giving early thought to the tax structure of any development
has always been vital for both avoiding any tax pitfalls,
as well as maximising the opportunities to obtain valuable
tax reliefs. In particular substantial changes to the capital
allowance regime from April will in some cases have a negative
impact to commercial development but equally will in some
cases improve tax deductions compared to the existing regime,
so it is worthwhile getting to grips with the changes.

The Impact of Climate Changes and the Environment
Climate Change is making its way to the very top of the political
agenda and will, perhaps, affect the property and construction
industry more than any other. Flooding and other environmental

to a raft of regulatory controls that impact significantly
on property development and construction.

Green Leases - Am I Bothered?
Why should a Landlord increase capital expenditure on measures
which make premises more efficient if the Landlord derives
no benefit? Recent initiatives by the Australian Government
have highlighted the possibility of collaboration between

may increase capital expenditure but which ultimately provide
a better return for both parties.
