The changes made to the TUPE Regulations in 2006 introduced
a broader definition of a 'transfer' for the purpose of the
Regulations, meaning that over time most organisations will
find themselves grappling with a TUPE transfer, often in the
form of a change of service provider.
In this session we will provide practical guidance on the
new regime, its impact and the obligations it imposes on both
seller and purchaser, or incoming and outgoing contractor.
With cases on the new regime now reaching the courts, we look
at how they are interpreting the Regulations, including considering
what steps can be taken post transfer to harmonise terms and
when employees can "cherry pick" the best of pre
and post transfer terms.
Finally, we will look ahead to additional responsibilities
being placed on purchasers and incoming contractors as a result
of changes being made to immigration legislation, and what
this means in practice.
