Della's Claim

Claim arising from delay in diagnosis of Cushing Disease between 1995-2001

Claimant suffered physical and psychological symptoms. Untreated this condition has 50% mortality within 10 years. A limited admission of liability was made in that negligence and delay in diagnosis and treatment was accepted but causation was denied (save for minor symptoms). Causation and quantum were particularly complex. It was necessary to identify each of the claimant's various conditions and determine the probable cause thereof then link them to the delay in surgery. Quantum was complicated further as the claimant was a self employed accountant with her own business. The claim was settled for £350,000 (involving PSLA estimate at £40,000).
