Letting International Ltd v Newham London Borough Council. The Court of Appeal allows Letting International's appeal against a decision not to impose an interim injunction on Newham London Borough Council.

Letting International issued proceedings against Newham London Borough Council claiming that it had acted in breach of the Public Contracts Regulations 2006 when conducting the tender procedure for contracts for procurement, maintenance and management of private-sector, leased accommodation. Letting International sought an injunction to prevent the local authority from entering into any further contracts until the conclusion of proceedings. The application was refused. The Court of Appeal stated that the most important question in this case was whether or not there was a serious issue to be tried. The Court of Appeal held that loss of a chance to compete for a tender could be enough to fuel a claim and that the judge had erred in his decision that there was not a serious issue to be tried.

The full text of the case will be reported when it becomes available.
