The team deals with all disputes relating to Wills and the
administration of estates, including disputes relating to:
1. The validity of Wills and Codicils.
2. Negligent advice on the creation and provisions of a Will.
3. The mental state or capacity of the person making the
Will
4. Incorrectly administered estates
5. Family provision
One way of assessing whether you have a potential claim is
by asking yourself the following questions:
1. Was the testator (the person making the Will) suffering
from any mental illness at the time he made his Will which
meant that he did not understand the consequences of what
he was doing?
2. Are you happy that the Will being administered is the
last Will of the deceased? Or do you think there is a later
one?
3. Does the Will accurately reflect the deceased's wishes?
4. Do you think that the deceased was badly advised on the
provisions of the Will? For example, does it seem that inheritance
tax is being needlessly paid?
5. Did you depend for financial support on someone who has
now died and not left you with sufficient money to live on?
6. Do you think that the executors (or any beneficiaries)
of an estate of which you are a beneficiary have acted improperly
and your share of that estate has been reduced as a result?
