Dealing with Insolvency is often difficult and stressful. Access to experienced-based advice can often make a real difference. At Charles Russell, we offer our expertise to help corporate and individual clients to negotiate the complicated legal issues that insolvency involves. Whether you are affected by insolvency directly, or indirectly through financial problems of your own customers, clients, tenants or suppliers, we can help.

Corporate
Experience is available on all corporate insolvency related issues, including:

Administrations (both pre and post Enterprise Act 2002)
Administrative Receiverships
Liquidations (voluntary and compulsory)
Company Voluntary Arrangements
Insolvency Act "offences" such as transactions at an undervalue, wrongful / fraudulent trading and preference claims
Factoring and discounting (including enforcement of security and ledger recovery)
Disclaimers, forfeiture and distress of commercial property in relation to insolvent arrangements
Director disqualifications and undertakings

The Insolvency Unit currently acts on behalf of Insolvency Practitioners, SME's, FTSE listed companies, factors and discount houses, commercial landlords, company directors, shareholders, banks and other financial
organisations, as well as for borrowers themselves.

Reconstruction and refinancing of companies in financial difficulties are handled in tandem with our corporate finance group. We have excellent relations with a wide variety of Insolvency Practitioners of standing with whom we are happy to put clients in touch where this is the best option. view more

Individual
In addition to advising Trustees in Bankruptcy, we are adept at advising individuals (in their own right, or in their capacity as partners or directors) who may need to resort to one or other of the insolvency options available to them (such as bankruptcy, both pre and post Enterprise Act 2002) and Individual Voluntary Arrangements. view more

Compliance
We also advise Practitioners who may either be encountering difficulties with their Recognised Professional Body, or have unwittingly exposed themselves to a negligence claim, or taken some step which may require rectification by the Court.

The Insolvency Unit is uniquely positioned to advise on compliance due to its experience in advising the Insolvency Practitioners Association. We offer talks, seminars and briefing notes of interest to our many clients.
